the company Trio-Tiff SCRL (RydNails),which headquarters are located : 1170 Brussels, Middelbourg Road, 124/13,is a natural and artificial nail products supplier, registered to the Carrefour Bank under the number: 0464 084 523.

Article.2.
except the agreement of an express and written dispensation between the 2 parts, relations between Trio-Tiff SCRL (RydNails) and its customers are ruled by the present terms and conditions of use. Those terms are supposed to have been accepted by the customer and assuming the possibility of be in contradiction with its own buyer terms and conditions of use.

Trio-Tiff SCRL (RydNails) ‘s support to the client's terms and conditions of use will never be deduced from any  order or parcel that Trio-Tiff SCRL (RydNails) would have accepted without any protest against the deductions referring to the customer's terms and conditions of use.Not to have received those information in its mother tongue does not exempt the customer to apply these terms of use.

The Conditions of use and the website Trio-Tiff SCRL (RydNails), like the contents, in spite of the fact that they are available for consultation internationally, have been drafted and formatted exclusively for customers in Belgium. Others foreign customers have to be aware that some dispositions of the terms and conditions of use will not be applicable to them or invoked by them, without so far, disabling the totality of the terms and conditions of use.

Trio-Tiff SCRL (RydNails) reserves the right at any time to change or modify the terms and conditions of use without advising personally the customer leaving him no possibility to pretend to any indemnification. Thus, it is from the customer's responsibility to verify periodically the modifications that came up.

Article.3.
special offers and price lists are established and communicated to the customer with no strings attached. Trio-Tiff SCRL (RydNails) is In this regard committed to its customer only after the customer's written or electronic confirmation, or as soon as Trio-Tiff SCRL (RydNails) will have initiated the execution of the contract.

Article.4.
Orders will only be placed on the website www.rydnails.be, by  mail, or on the phone. An additional variable lead time for the order manual coding must be anticipated.

Article.5.
The payment of orders placed on the website  www.rydnails.be is exclusively completed before shipping and without any discount. The payment for orders bounded for foreign destinations is processed via Visa or MasterCard, or advance payment on the IBAN bank account number : BE20 0013 3672 and SWIFT Bank code : GEBABEBB . Trio-Tiff SCRL (RydNails) guarantees credit card numbers privacy. The collection fees linked to the payment entirely  depends on the customer.

Article.6.

The nonpayment of an invoice at the deadline leads by full right and without any prior requirement to:

a) Immediate repayability and by full rights of all the invoices not expired yet; for these invoices, the deadline date will correspond to the first overdue invoice

b) the balance will increase due to 1% of interest per month, each month started considered as a completed month. The amount owed will also be markup by full right and without any prior requirement from 15% of the owed amount with a 125 Euros minimum, on a diehard basic penal clause.

c)the authorization to put an end or terminate any other running operation. An extension of the due date granted does not mean any renunciation from Tiff SCRL (RydNails) in the application of the mentioned conditions.

Article.7.

Except for sold out items, in case of force majeure or in case of file analysis, the parcels are shipped on the Belgian territory in the respect of the notification on the delivery page of the website

Trio-Tiff SCRL (RydNails) will under no circumstance be responsible for parcels delay in the delivery, deterioration or loss.

Proceedings in case of loss, damage or delay have to be determined by the customer directly with the carrier concerned that will compensate depending on the rules established.

Potential delays will under no circumstances allow the right to damages allowance. The intra or the extra territorial shipping costs depend on the customer whatever the quantity ordered.

Article.8.

In dispensation of the article 1583 of the civil code, Trio-Tiff SCRL (RydNails) remains the owner of the products sold until a complete payment of the original invoice and/or interests and/or basic allowance.

Hereby, the customer transfers to the seller, the amounts that a third party could owe him. The client discharges Trio-Tiff SCRL (RydNails) from any formality of signification and will not support potential costs pertaining to it. On the top of that, the customer enables Trio-Tiff SCRL (RydNails) to get its materials back at any time, wherever. As much as required the customer also authorize Trio-Tiff SCRL (RydNails) to enter their premises.

Article.9.
The customer will benefit from an online support for the Trio-Tiff SCRL (RydNails) products purchased.However we invite you to consult first of all the information concerning the products on our website, with the result that Trio-Tiff SCRL (RydNails) will focus on real problems. Ordered products are not refund or exchanged

Article.10.
Trio-Tiff SCRL (RydNails) limits its guaranty to the goods delivered that are still under the fabricant warranty. As far as its conditions and it extent enable.

Trio-Tiff SCRL (RydNails) will limit in any case its intervention in the replacement of defective items or in the refund of amounts payed, without any possibility for the customer to pretend to any damages, shipping costs to the fabricant is at the customer's exclusive charge, similarly for the return to the sender.

Trio-Tiff SCRL (RydNails) under no circumstances could be blamed for the non-performance by the fabricant of its own obligations related to the guaranty, notably in the case of fabricant's bankruptcy. The guaranty will be limited to any mechanic piece that had been used in the strict frame of its original theorical use.

Article.11.
Trio-Tiff SCRL (RydNails) will not assume any responsibility corresponding to material damages or losses or others, of any kind, that the customer or a third party could suffer following the transport, the deposit, the positioning, the use or the performance of the delivered products. In a non limitative way, are pointed out notably damages concerning material, premises, customers, designers and goods belonging to the designer's customers or other third party, exploitation losses or corporal damages.

Article.12.
Trio-Tiff SCRL (RydNails) informs its customers as much as necessary that the website www.rydnails.be can contain links or hyperlinks of other websites.

  Trio-Tiff SCRL (RydNails) exempt itself from responsibilities concerning the content  that appears on a linked website or for any product or service references by the linked website.

Article.13.
sale and shipping of goods by Trio-Tiff SCRL (RydNails) does not involve any cession of intellectual rights. Those rights remain the property of Trio-Tiff SCRL (RydNails)'s retailer and the customer commit not to arm them.

Trio-Tiff SCRL (RydNails) declares that regarding its knowledge, the delivered products do not contain any outrage to a third party's intellectual property. Trio-Tiff SCRL (RydNails) will not assume in any case the responsibility related to property's disputes, practice or violation of intellectual rights related to the sold items, that could come up

"RydNails" is a protected and registered brand, no one except Trio-Tiff SCRL has the right to use this mention without any written agreement recognized by Trio-Tiff SCRL (RydNails).

Article.14.
In the framework of mail order sailing to customers remaining in the application of the law of 14th July 1991, modified by the 25th may 1999 law,the customer has the right to notify to the seller that he cancels the purchase, without any fee and without motive explanation, within 7 working days from the reception's next day. Besides This renunciation will take effect only if the customer notifies by registered mail and if the goods are still in their original packaging and unused.

In case the customer would use this option, he will send the goods back Trio-Tiff SCRL (RydNails),by any mean, et his own risk and at his own charge.We consider customer; any physical or moral person that acquires or use for himself, for purpose excluding the professional specificity of the products or services saled.Thus, this clause cannot be applied to fisical or moral persons who acquire the RydNails products for professional use, that is supposed to be for all our customers, our products being of a professional use. Shipping costs, payment fees and others charges will be nevertheless paid by the buyer.

Article.15.
While ordering on the phone, by email or on our website www.rydnails.be,teh  customer authorizes expressly Trio-Tiff SCRL (RydNails) to proceed to the personal data handling and use them with internal management purposes of the brand. We consider as «company's internal management", the customers administration, orders, deliveries handling, billing services, solvency monitoring, along with marketing and customized advertising.

The Customer who orders on the phone or on the website www.rydnails.be can ask at any time to consult, correct or delete personnal data that Trio-Tiff SCRL (RydNails) would have registered about him by writing a petition, to the Trio-Tiff SCRL (RydNails)'s headquarters. For further information, the customer is invited  to contact the public records updated by the commission for the protection of privacy.

Article.16.
Except for prior agreement, the customer is committed not to resale, redistribute, or export the purchased goods. The customer is only allowed to resale the products, bound to final customer, but which does not need any particular training for the appropriated use of the product. Only dealers authorized by Trio-Tiff SCRL (RydNails) are allowed to resale products requiring a special training with the Rydnails products.

Article.17.
The RydNails training programs belong exclusively to Trio-Tiff SCRL (RydNails).

In the frame of the training program, the promotion, commercial gift, special offer, will be viable only in case of total execution of the program by the student. Special conditions granted will no longer be available in case of cancelation or renunciation by the customer ( example : free travelling expenses, free daily supplement for the training at home);In case of failure at the exam in the frame of the 5-days program at home, the student will be allowed to retake the exam, without any additional fee( except travelling expenses)

Article.18.
if one of the present condition is declared void or unsuitable, the other present conditions would remain entirely  current and this condition will be applicable as far as permitted by the law.

 Article.19.
all the parties accept, in the frame of their relationship, the electronic proofs means used.

Article.20.
the dispute related to the conclusion, the validity, the interpretation or execution of the contract or the present conditions of use are exclusively govern by the Belgian law and only submitted to Brussels's tribunals.
